Terms of Service

1. Parties and Definitions

This Software as a Service Agreement ("Agreement") is entered into between app-factory.dev Limited, a company incorporated in England and Wales with company number 16567409 ("Provider", "we", "us", "our") and the individual or entity accessing our services ("Customer", "you", "your").

"Service" means the PetPal software platform provided via cloud-based access, including all associated features, functionality, AI training recommendations, and documentation.

2. Service Provision

2.1 Service Availability:

We will use commercially reasonable efforts to make the Service available 24/7, subject to scheduled maintenance and circumstances beyond our reasonable control.

2.2 Service Modifications:

We reserve the right to modify, update, or discontinue features of the Service with thirty (30) days' notice for material changes.

2.3 Support:

We provide reasonable technical support during business hours (09:00-17:00 UK Local time, Monday to Friday).

3. Customer Obligations

3.1 Acceptable Use:

You agree to use the Service only for lawful purposes and in accordance with this Agreement and any applicable laws and regulations.

3.2 Account Security:

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.3 Data Accuracy:

You warrant that all information provided about yourself and your dog(s) is accurate to the best of your knowledge.

3.4 Compliance:

You must comply with all applicable laws regarding pet ownership and animal welfare in your jurisdiction.

4. AI Training Advice Disclaimer

4.1 General Information Only:

The training recommendations provided by PetPal are for general informational purposes only. They are not a substitute for professional veterinary advice, diagnosis, or treatment, nor are they a substitute for consultation with a certified professional dog trainer or animal behaviourist.

4.2 No Guarantee of Results:

Every dog is different. We cannot guarantee specific training outcomes. Results depend on many factors including consistency of training, individual dog temperament, and environmental factors.

4.3 Safety:

You are solely responsible for your safety and the safety of others when implementing any training techniques. If your dog shows signs of aggression, fear, or any concerning behaviour, consult a qualified professional immediately.

4.4 Veterinary Matters:

PetPal is not a veterinary service. For any health concerns about your dog, consult a licensed veterinarian. Behavioural changes can sometimes indicate underlying health issues.

5. Intellectual Property

5.1 Service IP:

All intellectual property rights in the Service, including our AI models, training content, and software, remain our property or that of our licensors. You receive only a limited, non-exclusive licence to use the Service.

5.2 Your Content:

You retain ownership of content you provide (such as photos of your dog, training logs, etc.). You grant us a licence to use this content to provide the Service and improve our AI models.

6. Fees and Payment

6.1 Pricing:

Current pricing is available on our website. We reserve the right to change prices with thirty (30) days' notice.

6.2 Free Tier:

We may offer a free tier with limited features. We reserve the right to modify or discontinue free offerings at any time.

6.3 Subscriptions:

Paid subscriptions renew automatically unless cancelled before the renewal date. You can cancel at any time through your account settings.

7. Limitation of Liability

7.1 Service Limitations:

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE.

7.2 Liability Cap:

Our total liability for any claims arising from this Agreement shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

7.3 Exclusions:

We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to injury to any person or animal, property damage, or loss of profits.

7.4 Your Responsibility:

You acknowledge that you are solely responsible for your interactions with your dog and any third parties (humans or animals) during training. You assume all risk associated with implementing training techniques.

8. Indemnification

You agree to indemnify and hold harmless app-factory.dev Limited and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

9. Termination

9.1 By You:

You may terminate your account at any time through your account settings or by contacting us.

9.2 By Us:

We may suspend or terminate your access for violation of these Terms, non-payment, or at our discretion with reasonable notice.

9.3 Effect of Termination:

Upon termination, your right to use the Service ends. We may delete your data in accordance with our Privacy Policy.

10. Governing Law

This Agreement shall be governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
